A. Agreement to Terms

As a SaaS provider, all products and services offered by HeadshotMaster are non-tangible and irrevocable. Because AI generation credits are delivered immediately upon payment, we do not issue refunds once an order is completed and delivered. Please read these Terms carefully before making any purchase.

These Terms of Service ("Terms") constitute a legally binding agreement between you, either personally or on behalf of an entity ("you"), and HeadshotMaster ("we," "us," or "our"), governing your access to and use of the website at https://headshotmaster.io and any related media, media channels, web applications, mobile websites, or mobile applications linked or connected thereto (collectively, the "Site").

By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM USING THE SITE AND MUST IMMEDIATELY CEASE USE.

We reserve the right to modify these Terms at any time at our sole discretion. We will indicate changes by updating the "Last Updated" date at the top of this page. Your continued use of the Site after any such update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

The Site is intended solely for individuals who are at least 18 years old. Only users aged 18 or older may register for an account, access or use the Site, or make any payments through the Site. By using the Site, you represent and warrant that you are at least 18 years of age.

The Site is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to applicable law or regulation.

B. Intellectual Property Rights

Unless otherwise stated, the Site and all of its content — including but not limited to source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content") — and all trademarks, service marks, and logos contained therein (the "Marks") are owned by or licensed to HeadshotMaster and are protected by applicable copyright, trademark, and other intellectual property laws.

The Content and Marks are provided on the Site "AS IS" for your personal, non-commercial use only. No part of the Site, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, or otherwise exploited for any commercial purpose without our express prior written permission.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal, non-commercial use, subject to your compliance with these Terms. We reserve all rights not expressly granted to you.

C. User-Generated Content and AI Outputs

Your Uploads. When you upload photos or images to the Site ("User Content"), you retain ownership of your original content. By uploading, you grant HeadshotMaster a limited, non-exclusive, royalty-free license to process your User Content solely for the purpose of providing the requested AI services.

AI-Generated Outputs. Subject to your compliance with these Terms and applicable law, you own the AI-generated images produced from your User Content ("AI Outputs"). HeadshotMaster does not claim ownership over your AI Outputs.

Content Restrictions. You agree that you will not upload, submit, or use the Site to generate:

  • Any content that is sexually explicit, pornographic, or obscene ("NSFW content")
  • Images of minors in any context
  • Deepfakes, non-consensual intimate imagery, or any content designed to harass, defame, or harm any individual
  • Content that infringes any third party's intellectual property, privacy, or publicity rights
  • Content that violates any applicable local, national, or international law or regulation

Violation of these restrictions may result in immediate account suspension or termination without refund.

Data Deletion. Any photos or videos you upload will be permanently deleted from our servers within 24 hours of processing. We will never sell your uploaded content or use it to train AI models without your explicit written consent.

D. User Representations

By using the Site, you represent and warrant that:

  1. You are at least 18 years of age;
  2. You have the full legal capacity to enter into these Terms;
  3. All information you provide is accurate, current, and complete;
  4. You will not access the Site through automated or non-human means (bots, scripts, scrapers, etc.) without prior written authorization;
  5. You will not use the Site for any illegal or unauthorized purpose;
  6. Your use of the Site will not violate any applicable law or regulation;
  7. You have all necessary rights and consents to upload any images you submit to the Site, including the consent of any individuals depicted therein.

We reserve the right to suspend or terminate your account and refuse future access if you provide false, inaccurate, or incomplete information, or if you violate any of these Terms.

E. Credits, Payments, and No-Refund Policy

Credits. Certain features of the Site require the purchase of AI generation credits ("Credits"). Credits are a non-monetary, non-transferable digital entitlement and have no cash value.

Immediate Delivery. Upon successful payment, Credits are delivered to your account immediately. Because our services are digitally delivered and consumed upon use, all sales are final. We do not offer refunds, exchanges, or credits for any purchases.

Credit Expiration. Any unused Credits may expire as described at the time of purchase or in your account dashboard. HeadshotMaster is not responsible for expired or unused Credits.

Payment Processing. All payments are processed by trusted third-party payment processors (such as Stripe). HeadshotMaster does not store your payment card information.

Pricing Changes. We reserve the right to change our pricing at any time. Changes will not affect Credits already purchased.

F. Subscription and Cancellation

If you subscribe to a recurring plan, you may cancel at any time by contacting us at [email protected] or through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of the period for which you have already paid. No partial refunds will be issued for unused subscription time.

G. Prohibited Activities

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to bypass, disable, or interfere with any security or access controls on the Site
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Site
  • Use the Site to transmit any malware, viruses, or other malicious code
  • Collect or harvest any personally identifiable information from the Site
  • Use the Site in any manner that could damage, disable, overburden, or impair our servers or networks
  • Impersonate any person or entity, or falsely claim an affiliation with any person or entity
  • Generate, upload, or distribute any NSFW, illegal, or harmful content

H. Software License

We may make software available to you in connection with our services. If such software is accompanied by an end-user license agreement ("EULA"), the EULA governs your use. Absent a EULA, we grant you a limited, non-exclusive, revocable, non-transferable license to use the software solely in connection with our services and in accordance with these Terms.

All software is provided "AS IS" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. You assume all risks associated with its use.

I. Disclaimers and Limitation of Liability

Disclaimer of Warranties. The Site and all Content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability. To the maximum extent permitted by applicable law, HeadshotMaster, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the total amount you paid to HeadshotMaster in the three (3) months preceding the claim, or (b) USD $50.

J. Indemnification

You agree to defend, indemnify, and hold harmless HeadshotMaster and its officers, directors, employees, contractors, agents, licensors, suppliers, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including but not limited to any content you upload or generate.

K. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief for violations of intellectual property rights.

L. Security

HeadshotMaster employs industry-standard security measures to protect your data, including:

  • Payment Security: Payments are processed by PCI-compliant third-party processors (e.g., Stripe). We do not store payment card data.
  • Transport Security: All data in transit is encrypted via HTTPS/TLS.
  • Data Privacy: We do not sell or share your personal data except as described in our Privacy Policy.
  • Security Testing: We conduct regular security assessments and vulnerability scans.
  • Account Security: We recommend using strong, unique passwords and enabling any available two-factor authentication.
